A business or company name does not allow or give you exclusive trading rights or ownership over that name.

Conducting a trade mark search before deciding on a business or company name is highly recommended.  Registering a company name will not stop someone who has registered the name as a trademark.  If you register your new company name that is similar to an existing trademark you could land yourself in legal trouble.
